I know someone who is on a lease but refuses to give up their key to the residence. They claim to still a resident of the domicile and will not pay rent or utilities but still insist that they are entitled to enter the residence. What is the legal way to fix this problem?

This person does not reside in the home any longer but for some reason feels entitled to maintain copies of the house key and mailbox key. Is this legal?

I am not the landlord but a co-applicant on the lease.

      For canceling lease based on your state in either case you could go that route if yours does not you will need to replace the unpaid rent etc.

      As long as their name is on the lease they can have asset to your home. You need to go to the leasing office, explain the situation, and in most cases the will have a form for you and your ex-roommate to fill that will legally take them off the lease.

      If there is a securityy deposit, even if you both split the bill, it will all go to you, and any and all damages to the home thereafter.

      But that is the only way you can remove them…legally.

      landlord needs to take them to court if there is a breach of contract. In some states, one has to wait 3 months without payment to kik tenants out. Also read ur contract, all the answers are in there. If the person refuses to pay without just cause (i.e. significant repairs that the landlord has neglected to make, etc), he/she is in breach of contract justifying eviction. Tell the landlord to change the locks n bill the tenants the invoice, which they wont pay, but if it goes to court then bring it up. It sounds like something shady is goin on. Most landlords dont like to loose money…

      Call the landlord, explain the situation, and ask them to sign a new lease agreement with you alone. Either you or the landlord can change the locks at that point if necessary, but first you should sign a new lease agreement without the bad roommate.
      The landlord will sympathize, I promise.
