A couple question nearly becoming a cop within CA?

Specifically in the Los Angeles/Orange County area. How long does it hold? What do you have to do? Are there different routes you can lift? I ask for information but also for insight since I know that usually there are a lot of intricacies that empire dont think about resembling for instance when people enroll in the military and dont know what they enjoy gotten themselves into. I am interested in social work and criminology. I dont think I would want to be a traffic cop or a composition work cop or maybe not even a jail cop. I would approaching to work in the community. Do you get a choice?

A coworker spreading a rumor to my boss more or less me disappearing the company for a alien opening?

Hi all, thanks for any relief you can provide on this. In short, I wore a suit to work one day (without a tie) in my business cool office. I hadnt dropped off my dry cleaning surrounded by a while and was running short on clothes. I also happened to come contained by an hour late that day, but I have told my boss this in advance and it be fine. Anyway, a coworker made the assumption that I was coming from a job interview. She next told my boss that she thought I was looking for a new work elsewhere. Now, here’s the thing– I actually had an interview that hours of darkness after work for a part time/nights and weekends holiday job at a local department store. Just to earn some extra dosh and have a nice retail discount around the holidays. I have no intention of going away my 9-5 anytime soon. So anyway, the next day, i be offered the part time job, and contracted I would just let my boss know that I would be working on the side, as I didn’t mull over she’d have a problem with it. As I suspected, she did not own a problem, and actually thought it was a upright idea (and actually mentioned that bonuses may be small or non existent this winter for conspicuous reasons). At this point, she chuckled and said she was really worried when I came contained by to talk to her, because she had hear a rumor I was looking for a new errand. She thought that when I went to her office and asked her if she have a minute to talk that I was going to dispense my notice. She then told me who told her that and underneath what circumstances. Essentially, my coworker went to her and told my boss that she thought she should know that she thought I was looking for a untried job, so she could ‘be prepared’ for my exit. So, that’s the long and short of it. Obviously, it’s total B.S. office informer. However, I had considered not telling my boss more or less the new part time job– I indicate, it’s my business, and it’s not going to effect my performance, so I don’t feel similar to I’m obligated to tell my employer anything. But, like I said faster, I just felt it be best to be up front about it and let my boss know, because I didn’t imagine it would be a problem. But it raises the question- what if I hadn’t told my boss about my segment time job? She probably would have be analyzing my actions over the coming weeks. What if I banged surrounded by sick? He’s probably at another interview! See what I’m saying? I just focus that by spreading this rumor to my boss, my coworker jeopardized my good standing as a dedicated member of staff to my company (which I most definitely am). So, I guess my question is: Do I hold any legal recourse? Does this fall beneath the umbrella of creating a hostile work environment? Is anyone aware of any precedents that have been set surrounded by any regard to my situation (i.e. workplace gossip becoming a legalized matter)? In conclusion, let me just articulate that I’m planning on setting up a meeting with my boss and her boss to discuss the issue, but I want to know going within to it if there’s any legal evidence to support my complaints, or if it’s just nonspecific workplace gossip B.S. I’m sure they’ll understand where on earth I’m coming from, but I’d like them to agree that this is a serious matter and shouldn’t be tolerated, and I’d close to as much evidence as possible to back that up. Thanks in credit!

His employer now informs Max and his co workers that they cannot provide work for a 2 week period due to a close down “requested by their client” after which it is business as usual. What are the option for max about protecting his wages as their company is “unable to provide work”? It would be where people talk about what they’re stressing over, worried, etc and let others give them advice.

It would be for those who have no medical card, and can’t afford a therapist.
I appreciate it.

Seeking Legal Help for Rental Disputes

Filed Under legal | Comments Off

Ed Shin asked:

For obvious reasons, sharing a flat or house has become an increasingly popular way of living in the UK today. However, as a co-habiting arrangement, it is susceptible to problems and conflict that can sometimes require legal attention. Although it’s advisable to resolve conflict through mediation, you may need to turn to the law.

Why Should You Seek Legal Help?

Before you take the legal route, talk to your landlord about your concerns and retain proper records while ensuring that you’ve fulfilled your responsibilities. There are numerous situations which could warrant legal intervention - here are some of the more common ones:

•  When you face harassment or are being unduly pressurized by your co-tenant, flatmate, or landlord to leave the flat, and resolving it through talks or mediation fails. Your landlord cannot legally evict you without a court order provided you have not defaulted on payment of rent or other bill payments.

•  When repairs have not been done despite reminders or when your landlord fails to address other issues like discrimination, complying with regulations, or failure to maintain and provide proper rental records and documentation.

•  When your landlord withholds your rent deposit or charges you for other bills unfairly.

There are a lot of agencies and organizations within UK that offer legal assistance for those sharing a house or flat – both free and paid. Consult one of repute and remember to check their credentials.

How Should You Seek Legal Help?

Before filing a complaint, check with your local advice centre for help and guidance. Compile your evidence and have it ready. You should take care of the following factors:

•  Reliable witnesses who were present when the incident happened

•  Documentary evidence, e.g. rent receipts, payment receipts, rental agreement, statements, emails or other correspondence, written agreements, statements, receipts, etc.

•  Tangible evidence, e.g. damaged objects, photographs or videos that show the damage or incident, or accounts and testimonials from experts.

The Citizens Advice Bureau offers free advice and is reputable. Search for your local CAB, approach your local Tenancy Relations Officer, you can also go to your local council to settle disputes.

For matters related to harassment and illegal eviction, the local councils have the power to start legal proceedings and, with acceptable evidence, carry out an investigation which may lead to prosecution if they believe an offence has been committed.

For matters related to money, you can approach the small claims court or in some cases the local county courts. Even if you feel the money involved is small, consult a certified legal representative. They are in the best position to give you accurate legal advice. You wouldn’t want to be stuck in a maze of legal complexity.

End Note

Remember that legal implications may also vary depending on your tenancy status, so it’s always better to seek an expert’s advice.

Think matters through once again to figure out if it’s best to go down the legal route, and that you’ve tried the alternatives available to you. After all, sharing a property is a temporary living arrangement and supposed to make your life easier. However, if the severity of the crime warrants justice and you’ve decided to take the plunge, show conviction in your decision and comply with all legal norms. Listen to your lawyer and be prepared to devote time to the legal proceedings.

Specialization in the Legal Profession

Filed Under legal | Comments Off

Mark Reardon asked:

Trained in law and able to give legal advice, lawyers are also referred to by other names; American legal representatives are often referred to as advocates or attorneys. The term advocate is used when a lawyer acts on behalf of the person he is representing in a courtroom; for many, this is not something they wish to pursue, passing over cases to others that prefer this type of legal representation.

Matters of interpretation often require them to act as a legal advisor; this occurs when a client merely wants help on a legal matter or guidance in how to proceed in a case.

A lawyer who primarily spends time in court is called a trial lawyer; of particular importance in trial work is the ability to think quickly and speak with ease and authority.Trial lawyers actually spend more of their time outside the court; they investigate the case they are representing, talk to witnesses and arranging evidence, for example.

The legal system affects nearly every aspect of our society; whether buying a home to crossing the street, lawyers hold positions of great responsibility and are obliged to follow a strict code of ethics. Depending on what area of specialization they work in will decide whether they practice in a courtroom; although they are all able to represent their clients in this manner when required.

Lawyers can specialize in a number of different areas of society; such as:Intellectual Property Rights, Health Issues, Contract Law, Marine Law, and Fraud.

This specialization means that some legal representatives may never have to practice their skills in court!

Environmental law for instance employs experts who will represent private, government and individuals; an example of this group could be construction firms, federal agencies, oil companies.

It is not all glamour though as much of the work involves resolving land disputes, planning licenses and land administration; although they may also be called upon to challenge or defend other civil actions.

Some attorneys concentrate in the growing field of intellectual property rights; protecting clients’ claims to copyrights, artwork under contract, product designs, and computer programs. Major insurance companies usually employ lawyers in their legal department; their purpose is to protect the company’s interests against fraudulent claims and advise on the legal terms and conditions used in policies.

Most attorneys work in the private sector working on criminal or civil law; criminal lawyers defend or prosecute persons charged with a crime; whereas civil law affects areas like wills, trusts and mortgages for example.

Another high profile legal position is in cases where the public interest is served; these usually involve disputes or claims against governments or large corporations. Still other lawyers use their skills working for non-profit organizations and other charitable bodies; these attempt to serve disadvantaged people wherever they are from often oppressive governments and companies.

Cash Gifting is it Legal?

Filed Under legal | Comments Off

Ron Fara asked:

This is the thought most people have when looking at the concept of Cash Gifting. They are shocked at the idea of giving and receiving money as a gift could be totally legal.

Here is a reality check.  IRS Tax Code Title 29 and Publication 950, a person can give up to $12,000 in a calendar year.  There are special tax situations that need to be followed for gifts received over $12,000; however, even in these special tax situations they are worth checking into  or this stay at home business.

It is  smart to question whether or not this Cash Gifting business is legal according to law.  However, you do not have to wonder anymore.  Simply look up the IRS Tax Code to learn in  for yourself how perfectly legal it is.

Not only are people concerned about the exchange of tax free money, but they are also concerned on whether or not Cash Gifting is a pyramid scheme.  The more modern Cash Gifting programs are not pyramid schemes.  This is not to say that older programs are pyramid schemes.  This is only to point out that the Cash Gifting business has evolved into a very lucrative and secure business. A person who joins a Cash Gifting program today can generate just as much gifts as a person who joined previously.

Although Cash Gifting is a legal activity, there are people out there ready to take advantage of the gullability of people looking into any type of business.  Therefore, before actually starting an online Cash Gifting program, it would be wise to check the background of the online Cash Gifting program you are considering.

There are plenty of legal gifting programs out there.  When researching into these legal gifting programs, you should first start out by doing a Cash Gifting review.  However, when doing a Cash Gifting review, you should pay particular attention to the sources of this review.  Anyone person can write a review.  Make sure it is a knowledgeable source. When searching legal gifting programs, you should make sure that the program you are considering has a cash expert gifting coach that is willing to give you the help you need to get started and mentor you throughout the program.

A legal gifting program should give you references of those already in their program so that you can talk with them about their program. This is a business that can literally change your life, as well as the lives of others.  This business is based on the idea of giving to receive.   You should see results quickly; however, it will take some work.

Although this business has been thought of as the overnight cash system, it will take time to get past the learning curve.  It is a fast and easy process, but as with any business, the more time you put into it, the more you will be rewarded

You are encouraged to look into the legalities of Cash Gifting.  Once you have conducted a thorough review into the legal gifting programs out there, you can then reap the benefits and satisfaction of helping others while helping yourself.

Download Music Legally

Filed Under legal | Comments Off

Nkeno Kapya asked:

Let’s face it, the majority of today’s youth over the age of 12 know how to manipulate a computer better than their parents. They are also much more knowledgeable in technology in general; be it the latest cell phone or the newest mp3 player out in the stores. What is mp3 ? That is a question you will hear most often from parents when talking about the subject. They may have heard of the ever-popular iPod, but do they even know what it looks like ?

It is estimated that by 2010 there will be approximately 300 million mp3 players in circulation. That is astronomical ! Mp3 is basically a musical format which is compressed whilst retaining the quality of the sound. It isn’t the only format in existence, but is the most recognized. You also have WMA (Windows Media Audio - used by Windows Media Player), AAC (encoding technique employed by Apple), ATRAC (used by Sony), and a few others. Some mp3 players will not play WMA files, for example. There are ways of getting around this but it usually involves some illegal manipulation of the music files. WMA files can only be played and copied for a limited number of times.

With internal capacities of up to 60 gigabytes (approximately 30,000 songs), today’s digital music players are in hot demand. Almost every teenager has one. People are willing to spend over $400 to get their hands on the latest gadgets capable of storing an unprecedented number of songs (and other media files such as videos and pictures). How do you transfer this media onto your newly-acquired mp3 player ? Scores of people are still downloading music illegally on the internet, infringing copyright laws. Others download their music legally.

Apple has its popular online music store, iTunes. Sony recently launched Connect, and Real has Rhapsody. All these are legal music downloading services with a low monthly service charge, with a small additional charge for downloading a song. The cost varies between 79c and 99c per song.

With Rhapsody, for example, one has the possibility of browsing their entire catalog of over 2 million songs and creating a personalized playlist. You can listen to the songs as many times as you wish.

Using the legal music downloading services such as the aforementioned ones is a far better option for you the consumer, and your PC ! The RIAA is actively pursuing file-sharers (illegal music downloads) and serving them with lawsuits. Just like the AIDS virus, the RIAA doesn’t discriminate. They once sued a 12-year old girl for sharing copyrighted music online. Nobody’s immune.

Another downside to downloading music illegally is that you are also downloading hundreds of viruses that can cripple your PC. They hide themselves within the music files and then attack your browser or registry.

You are better off paying less than $15 per month and download your music legally, than have to bear the embarrassment of a lawsuit, or having to purchase a new computer because a bunch of viruses have rendered it useless.

With their expert professional aid, legal recruiters can prove that recruiting attorneys is not, after all, a Herculean task. Some of the best known legal recruiting firms offer unique and effective methods to bring you highly qualified and efficient attorneys in the industry.

Prior to giving the nod to a recruiting firm, make sure to assess its credentials. A good recruiting firm will never force its clients to sign an agreement or violate your confidentiality terms. Once the choice for the recruiter has been made, the employer can shrug off his entire headache regarding the recruiting process. These firms do not target fresher or junior attorneys but highly experienced professionals who can benefit the employers with their services. Hot specialty areas include litigation (courtroom/trial work), real estate, corporate law (for both public and private corporations) and bankruptcy.

A number of recruiting agencies resort to cold calling just after an attorney has newly joined office. This is indeed frustrating and can even lead to your losing a worthy candidate. Employers should discuss this issue with the recruiters and ensure that such calls should not be made to their hired candidate at least before six months.

Good recruiting firms can bring you candidates from your desired geographical area. They primarily use three different sources to meet this goal, namely the Martindale-Hubbell Law Directory, the Internet, and the State Bar Associations. One of the oldest and best-known catalogues of lawyers in the United States, the Martindale directory offers a comprehensive list of well-known lawyers in the United States. The State Bar Associations have an extensive and searchable website elaborating the current status of the attorney, his/her experience, and whether or not he/she is in good standing.

These apart, good recruiting firms send only those candidates who can actually fit into your shoes. Besides the desired skill set, the recruiters evaluate the additional qualities of the candidate that would complement a successful match. So if you find your recruiter sending inappropriate candidates and demanding cash randomly, shrug off its services immediately.

Thus, apart from selecting the right legal recruiter, employers just need to relax throughout the entire process of attorney job search for their firm. Expert to the core, your chosen recruiter will certainly pick the right candidates searching for litigation jobs. So when your recruiter focuses on fit, not fees, you know you have come to the right place!
