John W asked:
I asked a question earlier about filing a lawsuit against my employer for termination based on an arrest that I recieved. My question this time is can I place any sort of lawsuit against the sherrif’s department or city in which I was arrested for a misdemenor crime that led to my termination at the police department for which I work? I was honestly arrested for a crime that I did not commit and no charges have been filed against me as of three weeks after I was arrested. My lawyer and I are absolutely confident that no charges will be brought against me considering all of the facts of the arrest. My lawyer also strongly feels that the sherrif’s department did not even have probable cause to arrest me in the first place and that made the arrest an illegal/unlawful arrest. Nonetheless, I was terminated at my place of imployment where I was planning on making a career as a police officer, ironically. Do I have a case? I worked in Illinois but I was arrested in Iowa County, Wisconsin.
To add a detail to my question…of course my lawyers are going to argue that the sherrif’s department had no probable cause but not only they are saying that. Every police officer I work with, including those who were involved in my termination, have said the same thing. Some are my friends. Others are not. I’m talking about peace officers who have been working for 30 years. Human Resources fired me. Not the actual police department. Every police officer I have actually asked has stated that the sherrif’s department had NO PROBABLE CAUSE to arrest me in the first place! I am a police officer myself…or at least I was…and trust me, I know they had none. The town I was arrested in has a population of 9 people. The cops there obviously were taking advantage of an arrest opportunity that I know they do not normally have. All I need to know is what are the laws in Wisconsin in this particular situation. Professional courtesy is obviously a joke in that state.
