Assuming someone has never been arrested before, how would they choose a defense attorney after they have been arrested, detained, or brought in for questioning? They’re in a jail cell or at a police station , and assuming they can afford a good attorney and will not use a public defender, how would they choose a defense attorney? Especially when they only have one phone call?
There shouldn’t be an appostrophe in attorneys.

A friend I work with is involved in a frivilous lawsuit where some woman who rear ended him is trying to sue him for 500,000 dollars. This would take everything he has in savings, his home and everything else he owns if she were to win and he would have to delcare bankrupcy. When the traffic part of this went to court he was found not to be at fault of the accident, but his lawyer in the civil lawsuit has told him that the results of the traffic court are not admisible in the civil lawsuit. He is afraid that due to the fact that she has a very good lawyer that she may win this case.

My advice to him was, that if he was sure she was going to win the case, I would take everything I owned before the trial and sell it. Then I would go out to Vegas and blow it like a rockstar. If there is nothing for her to take what can she do? If he has to declare bankrupcy over this, at least he gets a little satisfaction knowing she wont take all he owns. How would you handle this situation?
I agree that judges should have the comon sense to make the right decision, but this case is going in front of a Jury.
He had an old clunker of a car, so he just had collision insurance. The thing with the accident is that they were on the interstate. He came upon a wreck that was over a hill. He had to stop and she came over the hill after he did and couldn’t see him stopped till it was too late. She had a child in the car with her and the child had some pretty bad injuries (wasn’t wearing a seatbelt). That is where she is getting the 500,000 from.

Example, plaintiffs file “civil” lawsuit in (district) court. They serve me, the defendant. I respond. And the plaintiffs do nothing more … just let the case sit. Is there a time limit on their case to proceed, if so what is it generally? I am commenting on a New Mexico case. I know the reason the plaintiffs are not pursuing the case, cause they don’t have one, and now they are faced with a countersuit. Bottom line … how much time can pass before the court dismisses the case with prejudice?
