I have a civil lawsuit pending against me for over 40,000 for Alienation of Affection, it is incredibly simple the guy is blaming me for his mistakes and trying to see fault in everyone except himself but he wants over 40,000 in damages lets say he does somehow convince a jury that I was in part the reason for his divorce what would happen if they awarded him a large sum and I was unable to pay as most of my paycheck goes home to my mother who is disabled and needs it to live off of I have very little income I actually get

I’m writing in response to your lawsuit to a head of TBS sports division Mr Harvey Schiller and me (Eric Bischoff WCW exectuive vice president dated 24th of jan 1996, ) over the lack of sufficient characters in our company u explained to us in WCW turner broadcasting inc, that we generally keep to using the same four to five male individuals every week. And when I say that. I am by meaning the individuals you are clearly referring to our the macho man randy savage who is portrayed by randy POFFO. Hulk Hogan a leading American baby face hero who is portrayed by terry BOLLEA. Thirdly RIC flair who is portrayed by Richard FLEHIR. If the alleged victim of assault is proven by the defense attorney to have lied to the jury more than 10 times

If a defense attorney proves to the jury that the alleged victim has lied over 10 times to the jury about things not related to the actual alleged assault, would that jury believe what the alleged victim says about being assaulted? Also there are no witnesses, marks, bruises etc, only the alleged victims word against the defendants word. The defendant has not told any lies in court. Would the alleged victim have any credibility with the jury after being proven to have lied many times to that jury?

can a lawsuit for slander be declaired if they plaintiff slandered back?

I recently posted to a public forum thoughts and opinions about events from a divorce without actually naming the family and this person is now claiming they have obtained my personal info to link me to the my poster name and they claim to have an automatic win for a lawsuit, but yet this person posted back to my comments under 2 different user names and slandered me back admitting they know who the family is, attacked my character and then telling my user name under another poster name to retain a lawyer, wouldn’t these actions cancel out his lawsuit b/c thye are just as guilty, plus no false statements were made, and defamation to character doesn’t apply b/c no monetary loss can result from this, if the claim is unneccessary “mental” grief don’t I have the same complaint? They have told their children to harass mine and are the ones telling my kids were gonna be sued for everything b/c of what your mom did, aren;t they just setting themselves up for a loss at a countersuit?

While this question might be difficult (maybe impossible) to answer, I was curious as to a vague percentage? I’m trying to get a feel for the ethical issues of the occupation.
In other words, would you think that a crim. defense attorney’s clients are predominately guilty of the crimes they are accused of? Is it even possible for a lawyer to only defend whom they believe to be innocent?

If i am serving a lawsuit on a number of parties in CA and one of those parties is now a resident of another state outside of the court’s jurisdiction and became a resident prior to the compaints’ date of filing what legal recourse do I have if and when I win a judgement? I ask this because of what we all have seen with OJ Simpson. He lost his wrongful death suit, but moved to FL prior to the complaint being filed and was able to protect the lion-share of his assets and the Goldmans never recieved a dime until the court ordered the rights of that book to the goldman estate?
My question really revolves around if I have most of the defendents served and they make up the lion-share of the complaint is it worth my time and money trying to serve this defendent in another state and if I determine my case needs to depose this defendent during the course of the proceeding can I continue to try and serve defendent while in the midst of a case management hearing and or jury trial?

Okay, here’s the short version: My mother in law marred a very weird man (we’ll call them Sally and Bob) when my husband was 10. My husband (we’ll call him Pete) and his sister were adopted for insurance reasons. So now the kids have Bob’s last name. When my hubby Pete was 16, Sally and Bob got divorced. Bob was/is a very weird guy. The divorce was very messy and Sally told Bob never to talk to the kids again. When the kids where adults they also told him (bc he still tried to contact them) that they didnt want anything to do with him. So fast forward to present day. Bob filed for bankruptcy and left Sally with HIS college debt - $15,000!! They are currently in a lawsuit for him to pay her back the debt. So now, Bob is back to harrassing the kids. Pete and I moved out of the state for his job, and Bob found us. Figured out our address (only god knows how!!) and mailed us a letter. Now he is emailing Pete almost everyday. **So much for short version. To be continued**
He has taken pics off of our myspace pages (just the first default pic, since you have to be a friend to view our whole page) and has posted them on his myspace page and his personal website. He has posted very personal information about Pete and his sister on his pages as well.
We havent responded to any of his letters or emails. We just wanted to ignore him. But that is becoming very hard to do.
Is it possible to get a restraining order because of this?
Because of the lawsuit that Sally and Bob have, Bob has been ordered not to talk to Sally outside of court. So we’re not really sure why he has picked this time to try to connect with the kids again. They dont want anything to do with him. I’ve never met him and he’s posted very odd things about me, about always wanting me as a daughter in law.
Yes Monk. We are keeping all of the stuff together just in case we need to give it to someone. We didnt want it to come to all of this, but I think you are right. We need to start fighting back.
And Dragonfly - about the address. Yep, we moved and two months later we got a letter. We arent even in the phonebook yet! No one has our address that would have given it to him. It really creeps us out that he would be able to track us down like that. We still dont know how he got it. But he was my hubby’s dad for awhile, so he has all of my hubby’s info, like SSN and such. Scary stuff if you ask me!!

My Lawsuit is about to settle after 2 1/2 years and its not the money i want what options do i have ? see i am a 27 year old black man whom been in some fights in my life and when the insurance company found out through my medical records now they want to question my injury from a car accident a few years ago they dont think my injury came from the car accident along the course of my 2 year lawsuit my mom got into trouble with the law where i had to borrow a 5 thousand dollar loan that now blew up to 10 thousand dollars in 2 years so recently my lawyer called me up and told me he can settle my case for 20 thousand and i will come away with 4 thousand after 2 and a half years but on the bright sign my loan will be paid that i’ve borrow i think this sucks i am very upset i asked him to ask for more or take it to court but he doesnt think its a strong case what can i do ?

Does a victim have to agree to any deal regarding sentencing made between the DA and the defense attorney?

Okay my mom order an item from a company in California and she received it and the took payment so everything was well. But it turned out to be the wrong item so she returned it and did not receive her payment back. Later they took $114 out her credit card so she called for the reason and they said they sent her an item but she did not order it and she didnt receive the item either. She called several times trying toget her money back. So in the end she lost her money for two items and both items the company kept. So she was left with nothing and she did not agree to this. The company blamed it on the post mail sytem and the mail system told my mom to file a lawsuit against them that they had her back so what do yall think, can she file a lawsuit.
