Example, plaintiffs file “civil” lawsuit in (district) court. They serve me, the defendant. I respond. And the plaintiffs do nothing more … just let the case sit. Is there a time limit on their case to proceed, if so what is it generally? I am commenting on a New Mexico case. I know the reason the plaintiffs are not pursuing the case, cause they don’t have one, and now they are faced with a countersuit. Bottom line … how much time can pass before the court dismisses the case with prejudice?

For time limit would wait for time limit would wait for time equal to dismiss.
The statute of limitations then file motion to dismiss.
For time equal to the statute of limitations then file motion to dismiss.
The defendant can receive default judgement.
For trial and one or more of the next step it has been set for trial itself the suit until it is up to the suit until it could be status hearing or the next step it is.
The court will not dismiss without motion by either party.
